New Law Changes Deed Recording Process Starting August 5, 2025

White County residents, please take note — a new Arkansas state law will soon change the way property deeds are recorded.


Beginning August 5, 2025, Act 752 will go into effect, impacting how deeds can be submitted for recording at the White County Circuit Clerk’s Office.


Under Act 752, anyone submitting a deed in person or by mail must:


  • Be a grantor listed in the deed, or

  • Be someone who signed on the grantor’s behalf

  • Provide a valid government-issued photo ID (a copy is required if submitting by mail)



Deeds submitted without proper identification will be rejected.


Who is exempt from the new ID requirement?


  • Deeds submitted through electronic recording (e-Recording)

  • Attorneys

  • Licensed real estate professionals

  • Lenders

  • Title agents

  • Government entities

Circuit Clerk Sara Brown Carlton strongly encourages residents to review their documents carefully before the law takes effect to ensure they meet all requirements.


Additionally, residents are urged to sign up for Property Fraud Alert, a free monitoring service that will notify you if a document is ever filed under your name in White County records.
